1. Acceptance of Terms

Welcome to Luxe Stays & Casinos. These Terms & Conditions ("Terms") govern your access to and use of the website located at luxestaysandcasinos.com (the "Site"), including all content, features, and services offered on or through the Site. By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific sections of the Site.

If you do not agree to all of these Terms, you must not access or use the Site. We reserve the right to update or modify these Terms at any time, and such changes will be effective immediately upon posting on the Site. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.

2. Eligibility

The Site is intended for users who are at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher). By using the Site, you represent and warrant that you are of legal age to form a binding contract and to engage in the activities discussed on the Site, including but not limited to gambling, international travel, and hotel reservations, in your jurisdiction of residence.

We are an independent publication and are not affiliated with, endorsed by, sponsored by, or in any way officially connected with any casino resort, hotel, restaurant, airline, or other establishment reviewed on the Site, unless explicitly stated otherwise.

Pricing, room availability, amenity offerings, restaurant hours, gaming floor details, dress codes, and any other operational information about a particular resort are subject to change at the resort's discretion and without notice to us. While we make reasonable efforts to keep our content accurate and up to date, we do not warrant the completeness, accuracy, or timeliness of any information on the Site. You should always verify pricing, availability, and policies directly with the establishment before booking or travelling.

4. No Travel Agency Services

Luxe Stays & Casinos is a travel and lifestyle editorial publication. We do not act as a travel agent, tour operator, booking intermediary, or hospitality provider. We do not sell, resell, or broker reservations for any of the resorts reviewed on the Site. Any booking, reservation, or purchase you make as a result of information obtained on the Site is made directly between you and the relevant third-party provider (hotel, airline, tour operator, restaurant, or booking platform).

Such third-party providers have their own terms, conditions, cancellation policies, and privacy practices, which you are responsible for reviewing before completing any transaction. We are not a party to any agreement between you and a third-party provider and shall have no liability whatsoever in respect of such transactions.

5. Intellectual Property Rights

The Site and all of its content, features, and functionality—including but not limited to all text, graphics, logos, icons, images, photographs, audio clips, video clips, data compilations, software, and the design, selection, and arrangement thereof—are owned by Luxe Stays & Casinos, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may access, view, download (for caching purposes only), and print pages from the Site for your personal, non-commercial use, provided that you do not modify any material, do not remove any copyright or proprietary notices, and do not use the material for any commercial purpose without our prior written consent. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as expressly permitted above.

The Luxe Stays & Casinos name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Luxe Stays & Casinos or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

6. User-Generated Content

The Site may, from time to time, allow you to submit comments, reviews, ratings, photos, suggestions, ideas, or other content ("User Content"). When you submit User Content, you represent and warrant that:

  • You own or have the necessary rights and permissions to submit the User Content.
  • The User Content does not infringe any third party's copyright, trademark, privacy, publicity, or other personal or proprietary right.
  • The User Content is not defamatory, obscene, offensive, hateful, threatening, harassing, violent, discriminatory, or otherwise objectionable.
  • The User Content does not contain any malware, viruses, or other harmful code.
  • The User Content is not unsolicited advertising, promotional material, spam, or chain letters.

By submitting User Content, you grant us a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media, subject to our Privacy Policy.

7. Responsible Gambling Disclaimer

The Site discusses gambling as one component of the integrated resort experience. We do not encourage or promote gambling. Gambling involves substantial risk of financial loss and may not be suitable for all individuals. If you choose to gamble:

8. Travel and Health Disclaimers

International travel involves inherent risks, including but not limited to flight disruptions, visa refusals, customs issues, theft, illness, injury, civil unrest, natural disasters, and pandemics. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LUXE STAYS & CASINOS, ITS OWNERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (C) ANY CONTENT OBTAINED FROM THE SITE; OR (D) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless Luxe Stays & Casinos, its owners, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site, or your User Content.

12. Third-Party Links and Affiliations

The Site may contain links to third-party websites that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not endorse or make any representations about third-party websites, the information, materials, products, or services found on them, or any results that may be obtained from using them. Your access and use of any third-party site is at your own risk and subject to that third party's terms and policies.

The Site may, from time to time, participate in affiliate marketing programmes with travel booking platforms, hotel brands, and other travel-related services. Where applicable, we may earn a commission on qualifying purchases made through our links, at no additional cost to you. Such affiliations are clearly disclosed in the relevant content. Affiliate relationships do not influence our editorial recommendations or reviews.

13. Termination

We may, in our sole discretion, terminate or suspend your access to all or part of the Site at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users of the Site, to us, or to third parties, or for any other reason. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution provisions.

14. Governing Law and Dispute Resolution

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the State of Nevada, United States of America, without giving effect to any choice-of-law or conflict-of-law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Clark County, Nevada, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or confidential information.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court, you waive any right to a jury trial.

15. Severability and Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Luxe Stays & Casinos regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
